Terms of Service

1. Introduction
1.1. These Terms of Service (hereinafter - the “Agreement”) govern the use of the website https://elysiumskins.com (hereinafter - the “Service”), operated bySKYNEX LTD, a company registered in England and Wales under company number 16866353 (hereinafter - the “Company”, “we”, “us”, or “our”).
1.2. The Service provides Users with the ability to buy, sell, and exchange virtual items (“skins”) for games such as Counter-Strike 2 (CS2) and other supported games.
1.3. By accessing or using the Service, the User confirms that they:
- have read, understood, and accepted this Agreement in full;
- agree to comply with all policies of the Company, which are an integral part of this Agreement, including:
- • Privacy Policy
- • Cookie Policy
- • Security Policy
- • Refund & Chargeback Policy
- • KYC and AML Policy
- confirm that they meet the applicable minimum age requirements:
- • For Users located in the United Kingdom, the minimum age is 18 years.
- • For Users located in the European Economic Area (EEA), the minimum age is 16 years or the age established by national law, whichever is higher.
1.4. If the User does not agree with the terms of this Agreement or any of the Company Policies, or does not meet the minimum age requirement, they must immediately stop using the Service.
1.5. Role of the Company
The Company operates the Service as an intermediary platform facilitating transactions involving virtual in-game items. The Company does not act as a bank, payment institution, or electronic money issuer. Payments are processed via third-party Payment Service Providers (“PSPs”).
1.6. No Affiliation with Valve or Steam
The Company is not affiliated with, endorsed by, or sponsored by Valve Corporation or Steam. All trademarks, game titles, logos, and game-related content belong to their respective owners.
2. Definitions
For the purposes of this Agreement, the following definitions apply:
- Service - the online platform https://elysiumskins.com that enables Users to perform operations with virtual gaming items.
- Company - the legal entity operating the Service.
- User - any individual who has registered and uses the Service.
- Account - the User’s account created via Steam authentication.
- Transaction - any purchase, sale, or exchange of skins using the Service.
- Catalog - the listing of items available for trade on the Service.
- Payment System - any third-party provider enabling payment operations.
- Commission - a fee charged by the Company for facilitating transactions.
- Company Policies - the set of legal documents supplementing this Agreement, including the Privacy Policy, Cookie Policy, Security Policy, Refund & Chargeback Policy, and KYC and AML Policy.
3. Registration and Account
3.1. To access the full functionality of the Service, the User must log in via their personal Steam account.
3.2. The User guarantees that the Steam account used belongs to them and does not infringe the rights of third parties.
3.3. The User is solely responsible for safeguarding their Account, including:
- keeping Steam login credentials secure;
- ensuring their devices are protected against malware and unauthorized access;
- refraining from sharing access with third parties.
3.4. The Company reserves the right to suspend, restrict, or terminate accounts if violations of this Agreement or Company Policies are detected, or if fraud, suspicious activity, or security breaches are suspected.
3.5. Minimum Age Requirements
- For Users located in the United Kingdom, the minimum age is 18 years.
- For Users located in the European Economic Area (EEA), the minimum age is 16 years or the age established by the national law of the User’s country, whichever is higher.
By registering and using the Service, the User confirms that they meet the applicable age requirement. Users below the minimum age must not access or use the Service.
3.6. Data Collection for Minors
The Company does not knowingly collect personal data from individuals below the applicable minimum age. If the Company becomes aware that it has inadvertently collected personal data from a minor, it will promptly delete such data in compliance with UK GDPR and EU GDPR.
4. Relationship with Company Policies
4.1. This Agreement serves as the primary governing document for the use of the Service.
4.2. Each of the Company’s Policies is a legally binding component of this Agreement and must be adhered to by all Users:
- Privacy Policy - explains what personal data is collected, how it is processed, and how it is protected in compliance with UK GDPR and, where applicable, EU GDPR.
- Cookie Policy - governs the use of cookies and similar tracking technologies, in accordance with UK PECR and EU ePrivacy Directive requirements.
- Security Policy - defines technical and organizational measures to protect personal data, accounts, and transactions.
- Refund & Chargeback Policy - sets out rules for refunds and handling of chargeback requests.
- KYC and AML Policy - sets out rules relating to identity verification, anti-money laundering checks, sanctions screening, payout controls, suspicious activity handling, and compliance requirements.
4.3. In the event of any conflict between this Agreement and any Company Policy, the relevant Policy shall prevail with respect to the specific matter addressed by that Policy.
5. User Rights and Obligations
5.1. User Obligations
The User agrees to:
- comply with this Agreement and all Company Policies;
- provide accurate, complete, and up-to-date information when requested;
- not use the Service for unlawful purposes;
- respect the rules of Steam and other third-party platforms;
- refrain from fraudulent, abusive, manipulative, or automated activities;
- safeguard their Account credentials and not share access with others;
- notify the Company promptly of any unauthorized access or security breaches related to their Account.
5.2. User Rights
The User has the right to:
- access and use the Service in accordance with this Agreement;
- request assistance via official support channels;
- seek protection of their rights under English law and applicable UK regulations;
- exercise their data protection rights under UK GDPR and, where applicable, EU GDPR, including: Right to access, Right to correct, Right to erasure, Right to restrict/object, Right to data portability, Right to withdraw consent.
5.3. Age-related Rights and Obligations
- Users located in the United Kingdom must be at least 18 years old.
- Users located in the European Economic Area (EEA) must meet the minimum age requirement of 16 years or the age established by their national law, whichever is higher.
The Company does not knowingly collect personal data from individuals below the applicable minimum age and will delete such data promptly if it becomes aware of it.
6. Company Rights and Obligations
6.1. Company Obligations
The Company undertakes to:
- provide Users with access to the Service, except during maintenance or technical downtime;
- safeguard personal data in accordance with the Privacy Policy;
- implement appropriate security measures in line with the Security Policy;
- process support requests and complaints within a reasonable timeframe.
6.2. Company Rights
The Company reserves the right to:
- update or modify the Service and its functionality;
- impose or adjust transaction fees and commissions;
- restrict or suspend User accounts in case of violations of this Agreement or Company Policies.
7. Transactions and Fees
7.1. All payments are processed exclusively via third-party Payment Systems.
7.2. The Company may charge commissions or fees for transactions. Current rates are published on the Service and may change at the Company’s discretion.
7.3. Transaction Finality and Consumer Rights: Transactions are generally final once completed. This does not affect the User’s statutory rights under applicable consumer protection laws or the right to initiate a chargeback in accordance with card scheme rules.
7.4. Payment Processing and Fund Flow: All payments and payouts are technically processed by third-party Payment Service Providers (“PSPs”). The Company does not hold Users’ funds in its own accounts but may receive transaction-related fees and commissions as part of the payment flow facilitated by PSPs.
7.5. Card Payments: Card payments (Visa, Mastercard, etc.) are processed by authorised third-party PSPs. By submitting a card payment, the User confirms that they are the authorised cardholder and that the card is used lawfully.
7.6. Strong Customer Authentication (SCA): Users located in the UK or EEA acknowledge that card payments may require SCA in accordance with PSD2 and UK payment regulations. Failure to complete SCA may result in a declined transaction.
7.7. Chargeback Cooperation: In the event of a chargeback or payment dispute, the User agrees to cooperate with the Company and provide any reasonably requested information or documentation.
8. Payout Terms and Conditions
8.1. Payouts, where available, are subject to successful completion of all applicable identity verification, anti-money laundering, fraud prevention, payment compliance, and security checks.
8.2. Detailed rules relating to KYC verification, AML review, accepted documents, verification statuses, review timelines, payout controls, withdrawal restrictions, sanctions screening, suspicious activity handling, and prohibited conduct are set out in the Company’s KYC and AML Policy, which forms an integral part of this Agreement.
8.3. The Company reserves the right to request proof of identity, address, payment method ownership, source of funds, and any other information reasonably necessary to verify the User.
8.4. Payout functionality may be unavailable, restricted, suspended, or refused unless and until the User has successfully completed all required verification and compliance checks.
8.5. Withdrawals are permitted only to payment cards or other payment instruments issued in the User’s own name, in accordance with the Company’s KYC and AML Policy.
8.6. The Company may delay, reject, suspend, or reverse a payout where necessary for compliance, security, fraud prevention, technical, or PSP-related reasons.
9. Prohibited Activities
9.1. The following actions are strictly prohibited on the Service:
- using another person’s account or sharing one’s account with others;
- attempting to bypass Steam restrictions or other platform rules;
- engaging in fraudulent schemes, using automated bots, or manipulative trading practices;
- hacking, reverse-engineering, or otherwise interfering with the Service;
- distributing malware, phishing attempts, spam, or any malicious content.
9.2. A comprehensive list of prohibited actions is available in the Prohibited Activities Policy, which is incorporated by reference into this Agreement.
9.3. Prohibited Use of Payment Methods: The use of stolen, unauthorized, or unlawfully obtained payment cards is strictly prohibited and may result in immediate account suspension and reporting to relevant authorities.
10. Risks and User Responsibility
10.1. The User acknowledges and accepts the risks associated with using the Service, including but not limited to:
- volatility in the market value of virtual items;
- delays or errors in processing transactions;
- potential disruptions of Steam, third-party Payment Systems, or other platforms.
10.2. A detailed description of the risks associated with trading and using the Service is provided in the Risk Disclosure Policy, which forms part of this Agreement.
10.3. The Company shall not be held liable for any losses, damages, or inconveniences arising from actions of third parties or external circumstances beyond the Company’s reasonable control.
11. Limitation of Liability
11.1. The Company shall not be responsible or liable for:
- losses resulting from fluctuations in the market value of skins;
- technical issues or downtime of Steam, Payment Systems, or other external platforms;
- damages arising from improper or unauthorized use of the Service by the User;
- consequences resulting from the submission of false or misleading information.
11.2. To the maximum extent permitted by applicable law, the Company’s total liability to the User shall in all cases be limited to the total amount of commission fees paid by the User on the Service within the preceding three (3) months.
11.3. The Company shall not be liable for any delays, losses, or issues arising from the actions, errors, or omissions of third-party Payment Service Providers (“PSPs”).
11.4. Consumer Law Safeguard: Nothing in this Agreement shall limit or exclude any rights or remedies available to Users under applicable consumer protection laws.
12. Governing Law and Jurisdiction
12.1. This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.
12.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory law requires otherwise.
12.3. Nothing in this Agreement shall limit the User’s rights under applicable mandatory consumer protection laws.
12.4. EU Consumer Rights: If the User is a consumer residing in the EEA, mandatory consumer protection laws of the User’s country of residence shall apply.
13. Amendments
13.1. The Company reserves the right to update, modify, or amend this Agreement and any associated Policies at any time.
13.2. Updated versions become effective immediately upon publication, unless otherwise stated.
13.3. Continued use of the Service after such updates constitutes the User’s acceptance of the revised terms.
13.4. The Company will make reasonable efforts to notify Users of significant changes, but it remains the User’s responsibility to review periodically.

Users may submit complaints regarding the Service or payments by email to [email protected]. The Company will review and respond within 15 business days. This procedure does not affect the User’s statutory consumer rights.
